(ICR) and Pennyrile Christian Community squared off for the right to build a new class A signal at 91.7 in Madisonville, KY, and in the FCC’s initial analysis, ICR won the CP based on the point system. But then Madisonville’s commercial station, Sound Broadcasters’ WKTG (93.9), noticed that the proposed transmitter site for the new station was the tower it owned. That posed a problem, as Sound told the FCC: "At no time prior to filing or in the more than seven years that [ICR’s] application has been pending did ICR contact Sound or obtain consent from Sound to use the [Site]."And given what it calls ICR’s "lack of candor," Sound says it wouldn’t lease space on the tower to Hensley now. ICR told the FCC it did have permission from Sound to use the tower, but it couldn’t supply any documentation, or even the name of anyone it had talked to at the company – so the FCC has now dismissed Hensley’s Madisonville application, instead awarding the CP to Pennyrile.
